1. By enrolling in this Premium Service (hereinafter "PlaytimeVideo.com"), you become either a monthly subscription customer ("Subscriber"), or a Pre-paid Term User ("PRE-PAID USER") (Example 3month ,6 month, or Lifetime), and agree to be bound by this Agreement ("Agreement"). This Agreement is subject to change by "PlaytimeVideo.com" at any time. Notice to Customers shall be made by adding any changes to this "Terms and Conditions" document, which will remain posted at the Site. Customers agree to review these "Terms and Conditions" from time to time for changes and updates.
2. Some or all of the following fees and charges may be incurred by the customer: a) Subscription Fees: The monthly Subscriber is responsible for paying periodic monthly subscription fees according to the then-current billing terms. Subscription fees are non-refundable. Credit cards will be charged only after the customer has selected a service to purchase. Cancellation notification must be received during the 24-hour introductory period of signing up on ("PlaytimeVideo.com"). Notification must include your full name, username, password and site name for proper identification. Notices received after the deadline will apply to the next month.
3. Unless and until this Agreement is canceled in accordance with the terms hereof, the monthly Subscriber hereby authorizes the "PlaytimeVideo.com" to charge Subscriber's credit card to pay for the ongoing cost of membership. Subscriber hereby further authorizes "PlaytimeVideo.com" to charge Subscriber's credit card for any and all purchases of products, services and entertainment provided by "PlaytimeVideo.com."
4. Customers may not assign or transfer access privileges to any other person or entity. Customers must promptly inform "PlaytimeVideo.com" of the following: changes in the expiration date of any credit card used in connection with this Service; changes in home or billing address; apparent breaches of security, such as loss, theft, or unauthorized disclosure or use of an ID or password. Until "PlaytimeVideo.com" is notified by e-mail of a breach in security, the Customer will remain liable for any unauthorized use of the Service. Upon request, Customers will be given access to billing records that support charges for use of the "PlaytimeVideo.com."
5. Payment for the Services or products purchased may be made by credit card only. Subscribers will be automatically renewed for the original subscription term upon expiration unless "PlaytimeVideo.com" is notified via e-mail 7 days prior to expiration of a monthly or greater membership. All Trial memberships must give notice of cancellation within 24 hours after the initial signup has occurred. Notification must include full name, user name, password and site name for proper identification.
6. Subscription to this Service may be terminated at any time, and without cause. (YOU MUST Supply us with the proper Information such as your SUBSCRIPTION ID# or RECEIPT, If this is not supplied you will not get an Response from our site) , by either "PlaytimeVideo.com" or Subscriber upon notification of the other by electronic mail (e-mail). Subscribers are liable for charges incurred by them until termination of their subscription. A subscription will remain active until Subscriber receives e-mail confirmation of the cancellation.
7. All Customers are responsible for providing all personal computer and communications equipment necessary to gain access to "PlaytimeVideo.com." Access to and use of "PlaytimeVideo.com" is through a combination of user ID and password. Each Customer must keep his password strictly confidential. Remember your password! For security reasons, "PlaytimeVideo.com" will not release passwords for any reason, except as may be specifically required by law or court order. Unauthorized access to the Service is a breach of this Agreement and a violation of law.
8. Any liability of "PlaytimeVideo.com" including, without limitation, any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, alteration of, or use of records, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action, shall be strictly limited to the amount paid by or on behalf of the customer to "PlaytimeVideo.com" for the preceding 12 months. Some states do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.
9. No warranty is made by "PlaytimeVideo.com" regarding any information, services, or products provided through or in connection with the Premium Services and "PlaytimeVideo.com" hereby expressly disclaims any and all warranties, including without limitation: 1) any warranties as to the availability, accuracy, or content of information, products, or services; 2) any warranties of merchantability or fitness for a particular purpose. Some states do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.
10. Except for public domain material and electronic messages, all material displayed on this Site is protected by federal copyright and may not be copied, redistributed, or downloaded, in whole or in part, without the prior written consent of "PlaytimeVideo.com."
11. The material on "PlaytimeVideo.com" is for the private, non-commercial enjoyment of customers only. Any other use is strictly prohibited and is a breach of this Agreement.
12. This Service enables Customers to share information with other customers. Customers agree not to submit, publish, or display on this Site any defamatory, inaccurate, abusive, threatening, racially offensive, or illegal material. Transmission of such material that violates any federal, state, or local law, is strictly prohibited and is a breach of this Agreement.
13. Customers agree not to engage in advertising to, or solicitation of other Customers to buy or sell any products or services through this Site without prior written consent. Customers are responsible for information they send, or display through the Site even if a claim should arise after termination of the service.
14. There are no facilities provided by this Service for sending or receiving private or confidential electronic communications. All messages shall be deemed to be readily accessible to the general public. Do not use the Service for any communication for which the sender intends only the sender and the intended recipient(s) to read. Notice is hereby given that all messages entered into this Service can and may be read by the operators of the Service, whether or not they are the intended recipient(s).
15. Notices by "PlaytimeVideo.com" to Customers shall be given by means of electronic messages (e-mail) or by a general posting on the Site (which includes the updating of this "Terms and Conditions" document). Notices by Customers to "PlaytimeVideo.com" shall be given by electronic messages (e-mail) unless otherwise specified in the Agreement. All questions, complaints, or notices to "PlaytimeVideo.com" by means of electronic message must be sent to service@PlaytimeVideo.com.
16. The Customer hereby warrants and represents that he or she is over the age of 18, and in all respects is qualified and competent to enter into this Agreement.
17. COMPANY NOT RESPONSIBLE FOR THIRD PARTY OFFERS. "PlaytimeVideo.com" contains links to other related Internet sites, resources and sponsors of the Company, who, from time to time, will offer products and services that may be of value to you. Selection of one of these ad banners or links directs the User off of PlaytimeVideo.com to a third party. Transactions that occur between the User and the third party are strictly between the User and the third party and are not the responsibility of the Company. Because the Company is not responsible for these outside resources or their privacy policy or content, the User should direct any concerns regarding any external link to its site administrator or Webmaster.
18. This Agreement contains the entire agreement between the Customer and "PlaytimeVideo.com" regarding the use of the Service, and supersedes all prior written and oral understandings and writings, and may only be amended upon notice by "PlaytimeVideo.com" to Customers as described herein. Unless otherwise explicitly stated, the provisions of this Agreement shall survive its termination. The Agreement shall be governed pursuant to the laws of the Province of BRITISH COLUMBIA.
I, the customer, under penalty of perjury solemnly declare and affirm as follows:
A. I am an adult, being at least 18 years of age.
B. I am not accessing this material to use against the Site operator or any person whomsoever in any conceivable manner.
C. I will not redistribute this material to anyone nor will I permit any minor to see this material, or any other person who might find such material personally offensive.
D. I subscribe to the principles of the First Amendment which holds that free adult Americans have the right to decide for themselves what they will read and view without governmental interference.
E. I believe that such material does not offend the standard of the community in which I live.
